What Pennsylvania law adds
Two layers apply to any gift card held by a Pennsylvania resident, and the state layer is genuinely worth knowing because most people assume federal rules are all there is.
Federal — the Credit CARD Act of 2009. Gift certificates, store gift cards and general-use prepaid cards may not expire sooner than five years from issuance or the date funds were last loaded. Inactivity, dormancy and service fees cannot be charged until a card has been inactive for at least twelve months, only one such fee is permitted per month, and both expiry and fees must be prominently disclosed on the card or its packaging.
Pennsylvania. A gift certificate or gift card that remains unredeemed for two years or more from the date of sale or issuance is redeemable in cash for its cash value, or is subject to replacement with a new card at no cost to the purchaser or recipient. Separately, Pennsylvania's unclaimed property regime presumes abandonment where a certificate is unredeemed two years after any redemption period expires, or five years from issuance where there is no expiration date — with cards carrying no expiry and no post-sale fees exempt from that presumption entirely.
Section 402 of the federal Act expressly preserves state laws on dormancy, inactivity and service fees and expiration dates where those laws are more protective, so the Pennsylvania provision stands alongside rather than being displaced.
Where a card has escheated or a balance has been forgotten, the Pennsylvania Treasury operates a free unclaimed property search. If a retailer refuses a valid redemption request, the Bureau of Consumer Protection accepts complaints from Pennsylvania residents.
Why scammers love gift cards
Gift cards are the most demanded instrument in American consumer telephone fraud, and the reason is structural. A gift card code is a bearer instrument: whoever holds the number holds the value. There is no account holder, no chargeback, no reversal and no trace once the balance is spent or resold.
The Pennsylvania scripts are consistent across every card in this hub. A caller impersonates PECO, PPL, Penelec, Met-Ed, Duquesne Light, the Social Security Administration, the IRS, a county court, a sheriff's office, a bank fraud department or a grandchild in custody. Urgency is manufactured. The victim is directed to a nearby Giant, Weis, Wegmans, Rite Aid, CVS, Walgreens, Wawa or Sheetz, told to buy gift cards, and asked to read the codes aloud.
No legitimate organisation on earth accepts payment in gift cards. Not a utility, a government agency, a court, a police department, a bail bondsman, an employer, a landlord, or the retailer whose card is being demanded. Any request for gift card codes as payment is fraud, one hundred percent of the time.
Pennsylvania ranked sixth nationally for internet crime complaints in the FBI's 2025 Internet Crime Report, with more than 31,000 complaints and over $537 million in reported losses. The state's Bureau of Consumer Protection reported that 85% of the crypto fraud complaints it received came from people aged 60 or over — and the gift card equivalent skews the same way. The tax side, briefly
Buying a gift card with cryptocurrency is a disposal. You are exchanging property for goods, and the difference between your original cost basis and the dollar value at the time of purchase is a capital gain or loss.
Pennsylvania taxes net gains at a flat 3.07% with no progressive brackets and no preferential long-term rate, and federal capital gains rules apply separately. Critically, Pennsylvania does not permit capital loss carryforward, so a loss that exceeds your same-year gains is permanently lost for state purposes.

Can I buy cryptocurrency with a gift card?
Almost never. Retailer gift cards — Amazon, Apple, Google Play, Walmart, Target, Steam — are closed-loop and cannot be converted to dollars by a third party, so no licensed exchange accepts them. The only partial exception is an open-loop prepaid Visa or Mastercard, which sometimes works if you register it with your name and Pennsylvania address first.
